When is a contract not like a steak?

When is a contract not like a steakDoes this seem like a silly question? Humor us for a moment, because it will drive home the importance of reading and understanding the contract you must sign when a builder undertakes a construction job at your home. This applies to us, Archadeck of West Central & Southwest Ohio, and to any other reputable builder out there.

When you order a steak in a restaurant, there is an implied agreement between you and the restaurant that the steak will be cooked the way you want it cooked. When the steak is delivered to your table, if it does not meet your expectations, you can send it back, and they will cook another one for you. If you are unhappy with your meal, sometimes the restaurant even throws in a free dessert or gives you the whole meal for free, “just because.”

When you arrange for a contractor to design and build an addition to your home — even an outdoor living addition — you’ll need more than an implied agreement. For the arrangement to work, you and the builder must sign a contract. That way, everyone agrees on the expectations up front. No surprises!

Included within (or along with) your contract is the following information:

  • A description of the work to be done, also known as the scope of the project
  • The total exact price of the project, including materials, labor, permits and taxes
  • A specification sheet listing dimensions, special features and specific materials to be used
  • A detailed, labeled rendering created by an architectural draftsman based on our conversations about what the project will entail
  • Details about client responsibilities
  • A payment schedule
  • A method for dealing with amendments to the work, if needed
  • Details about how we, as the builder, will handle clean-up during and after completion of the job

When is a contract not like a steak You should not sign the contract for your new deck, porch or patio project until you are certain that you agree with and understand every detail in it. It’s important that we address any inconsistencies or concerns you may have before we get started. We never want to find out, later on down the road, that a customer had unrealistic expectations.

As you can see, the contract sets the tone and lays out the expectations for any construction project, no matter how large or how small. We take the contract very seriously. One area for potential misunderstandings is the timing of your outdoor living project. If we run into inclement weather while working at your home, we’ll need to take time away from the site until conditions improve. Also, addendums to your project while construction is underway, or problems obtaining the correct materials, can extend the completion date. Delays to your project will affect other clients in the queue for future start dates. Conversely, if we encounter delays at a project scheduled before yours, then your start date might be affected.

Does this “contract talk” sound boring? It may, but think about it this way: the concept of using a contract for the scope of a building project evolved because somebody somewhere had a misunderstanding about some work to be done. We want to avoid any such misunderstandings! The contract serves to set boundaries. Should we encounter differences of opinion during the course of our work together, the contract would serve to navigate our relationship through to the successful completion of your outdoor living project.

Remember that steak you ordered at the beginning of this article? Obviously, you can’t compare the journey of building an outdoor living space addition to that of ordering a steak at a restaurant. A steak will stay with you for about 24 hours, while a deck, for example, will be with you for 20 years or more. If something isn’t right with your project, or if there is an aspect you aren’t pleased with, we will work with you, within the contract, to make things right, but we can’t throw in a free pergola. Again, we will work with you within the contract; if it is not written in the signed contract, it is not and cannot be an expectation.

It is only natural to anticipate the enjoyment a new outdoor living space provides! But for Archadeck of West Central & Southwest Ohio, our first concern is getting the project done correctly, in a timely manner and with the safety of you and your family in mind.

Ensuring a smooth, timely project depends heavily on having all the “bases covered” in terms of planning. Most of the homework required to begin your outdoor living space is covered as part of our planning process. However,  there are items that the customer is responsible for and it is always best to have these prepared and in-hand prior to beginning your project, these include but are not limited to:

  • Gaining the approval from your HOA (Home Owners Association)?
  • Are there restrictive covenants that will not allow the build of your structure on that property of land? What about Green Space covenants?
  • Can you be prepared to pay for a stamped engineer letter on the plans if the need arises?
  • Do you have a plot plan that includes proper setbacks for building?
  • Have you received zoning approval from the city for the proposed use of land?

These are only a few of the factors that can affect the build timeline. It’s important to get the HOA’s approval to build since they have the final say on how the property will be altered. An HOA isn’t the only thing that can hold beginning and completion of your proposed addition back, there could also be restrictive covenants which can deny the build from happening on the property to preserve the value of adjoining land. These are all things we will ask you. It is your responsibility as the homeowner to research and provide information to ensure the build timeline is on schedule.

Dayton outdoor living with petsOnce the planning prerequisites have been addressed, Archadeck of West Central & Southwest Ohio also asks each of our clients to go over a “to do” checklist prior to our crews arriving to begin your project. These are in place to ensure not only a timely project timeline, but also as safety precautions for you, your family, your pets and our team members. These include but are not limited to:

  • Clearing the yard of any debris, including trash, animal feces, etc. and making sure the area is clean of any toys, or outdoor furniture.
  • In addition to cleaning up the yard where workers will be, make sure there is a designated area that materials can be dropped off, Archadeck wants to ensure the materials are being delivered properly and in a timely manner.
  • To ensure the safety of both furry family members and the Archadeck crew, we ask that you keep pets out of the area and put them in a safer environment during that period of building.

Various industry groups do annual surveys that provide numbers on this subject, but I’d like to share a few from my line of business.


According to the report, and based on the natural averages gathered during 2015, outdoor living spaces such as composite (low-maintenance) decks and wooden decks show a nice return on investment (ROI). A  midrange deck addition built of composite reflects a ROI of nearly 64.4%, with a deck addition built of wood recouping 75%. If you look closely at the project types listed below, you will notice that the ROI for a deck addition exceeds that of many of the traditional home improvement projects — such as roofing replacement. This is proof that outdoor living structures, such as decks, play a vital role in the value of our home’s design and the way we gauge their importance.

Looking into the history of our favorite backyard destination, believe it or not, have much to do with the industrialization and the post-war economy of America.

The popular Monkee’s song from the 1960’s conjures visions of backyards and barbeques.  Interestingly, until the 1950’s and 1960’s, the backyard was not the focal point of fun and relaxation as it is today.  It served a more practical purpose of being sustainable to support the family.  Families kept cows for milk, chickens for eggs and meat, and pigs as garbage disposals.  A garbage pile was located near the far end of the property many times along with an outhouse, so the backyard was usually filled with malodorous odors that made it less than conducive for relaxing outdoors. Quite a different picture than what the backyard is today — What had once been a place to grow food and sustain families has become a place of leisure and relaxation.

As we evolved so did our backyards. The American culture itself changed.  The evolution of the backyard began when households shifted from being self-contained and supportive to supporting the local economy of shops and stores.  Gone were the animals and odors once indoor plumbing and sanitation became standard practice. Gone too, was the labor of toiling for that night’s dinner.  Now there was actually time for leisure and relaxation.

civil war era photoAfter the Civil War, porches served as a place to relax and converse after a meal.  In the 1920’s, with the invention of the radio, families started to gathering in the living room to listen to the evening’s entertainment.  Because of the fear of automobiles blowing up, garages were placed to the rear of the property, taking up part of the backyard. Starting in the 1950s, the garage was then attached to the house, freeing up space.  The backyard was no longer thought of as a practicality. The idea of having your own little piece of green space behind the house in order to relax and to play was the new vision. The backyard became our haven from life, our refuge.

While no one knows exactly who invented the concept of the deck, there is evidence to suggest that patios were used in ancient Israel, either on the rooftop or the courtyard as a place of leisure and entertainment.  Decks in America were born out of the desire to entertain outside, becoming a key element to our homes, defining the backyard, part of our lifestyles,  just as the porch did in the front of the house earlier.

It was not until the early 1980’s, however, that decks really started come into their own as homeowners began to think about decks as an extension of their interior living space.  Previously, most decks were a simple 8 x 10 foot platform.  As Americans began having a more active, outdoor lifestyle the inside was brought outside.  Outdoor cooking, “grilling out” became the trend that made the deck an extension of the kitchen.  From the simple grill, the deck is now a fully equipped outdoor kitchen, with cooktops, refrigerators and warming drawers—even the kitchen sink.


Backyards are now customized to form an individual’s artistic expression and style, just like any other space in one’s home.  Today, decks can be integrated naturally with the house and surrounding property including natural elements of rocks, trees and running water into the design.  Other amenities that can be incorporated into the design are even more elaborate structures such as multiple levels and innovative shapes as well as pergolas, gazebos and roofs.  Because the decks are versatile in their design and entertainment value, they have become the outdoor great room where you can swing in a hammock, curl up with a good book or soak in the hot tub.  As a stand alone structure, or as an element in an entire outdoor living environment, today’s multifunctional deck does it all.

The one aspect that homeowners often dislike about their deck is the chore of maintenance. During the 1970s decks were solely built from of wood which requires annual maintenance. The last decade has seen an upsurge in wood alternatives such as all-plastic lumber and composites, which mix plastic with wood fibers. Synthetic materials currently account for about 15 percent all decking material sold in this country.

Big question MarkOut of all the questions homeowners ask us in regards to planning and building an anticipated outdoor living space addition, the most frequently asked is “WHEN is the best time to build?” Many factors can fall into play when answering this question, but in essence if you are  ready to pursue your addition then there is no time like the present to get the ball rolling!

While there is never really a wrong time to begin your outdoor living space project since we build structures year-round,  there are advantages to begin the process during the fall and winter months.

  • hassle-free no textAdvantage — A good  reason to begin your outdoor structure in the late fall and winter months is there may be less wait time to begin construction. Gaining approval through HOA’s and permitting will take less time because there is less backlog and this can often make the wait-time minimal in most cases. Making the decision to build now will ensure being able to enjoy the benefits of your new structure sooner and in plenty of time for the arrival of the outdoor living season in the months ahead. Keep in mind, when dealing with a quality builder wait times can be longer, especially during the warm season. Deciding on a fall/ winter project can greatly reduce those wait times.
  • Underside of a cedar shingle gazebo roofAdvantage — If you are considering a structure built from wood, a cooler month project timeline will provide many benefits. Wood requires a time period of acclimation and curing. The laws of expansion and contraction always apply when it comes to working with wood. All wood is hygroscopic, meaning that when exposed to air, it will release or pick up moisture until it is level with the humidity and temperature of the air. Humid conditions, such as those in summer, will cause more rapid expansion and contraction of wood that is not yet sealed for protection against the elements. A structure built from wood needs to cure for a period of time before the sealer or paint will properly adhere to the wood and promote beneficial protection qualities. By choosing to build during the fall & winter the least humid times of year, your new wooden deck or other outdoor structure will have ample time to cure in order to properly accept the sealer or paint you choose.
  • Winter projects mean less interruption of turfAdvantage — Your lawn and landscape will incur less stress by choosing to build during the cooler months of the year — this is because most turf grasses, trees and shrubs are in their dormant period during the late fall and winter. During dormancy, these plantings are less likely to experience permanent damage from having to be trimmed or pruned to accommodate the addition of a backyard space. Aside from the landscape, construction during the winter will cause less of an interruption to your family’s day-to-day activities and lifestyle as most people use their yards less during these months. This means the noises and materials will be less of an annoyance than they would be when you are using the yard a lot during the warmer months.
  • PlansAdvantage — Choosing to move ahead with your project now will save you money in the long-run. This is a driving factor that drives many “fence-sitters” to move ahead. From a legal and risk-management perspective, your contract is king. The contract sets the tone and the expectations for any construction project, large or small. Everything from the work description and its price, client responsibilities, payment schedule, method for dealing with amendments to the work, clean up details and even the timing is laid out in the contract. We make every effort to make the customer happy but there are boundaries. If it is not written in the signed contract, it is not and cannot be an expectation…period. This means upon completion, once the work listed on the contract is completed to your satisfaction we are done.

The following aspects of our contract ensure a clear understanding of the responsibilities and expectations of both parties

  • Our Business information – company name, address, phone number and our registered business number
  • customer serviceClient information – Your name, address and phone number and the address of the building work site if it is different than your residential address
  • Date – contract signing date
  • Work description/Project scope – A clear statement or series of statements to spell out precisely what work will be done by our team, including filing and obtaining permits, making the Call Before You Dig phone call to have utility lines marked and any construction related debris removal. Specific references to materials (dimensions, special features and any other details related to the project materials) are to be listed on the specification sheet
  • Price – The total exact price (costs of materials, labor and any taxes)
  • Archadeck differencePayment schedule – Clearly indicates the agreed upon amounts and specific times for payment due at various stages of project completion
  • Client responsibilities – A clear statement of your responsibilities which would cover such tasks as location/marking of underground drain lines and sprinklers and work site clearance and refurbishing upon the completion of our work. (this can include: removal and saving any shrubs, trees or plants you wish to replant, reseeding or sodding areas of the lawn disturbed because of construction, cleaning areas on the exterior of the home in close proximity to said project or the installation of softscapes like mulch or pea gravel)
  • Signature lines – It is vital that the signatures of both parties be included in the contract to make it binding
  • The labeled project rendering, specifications sheet and warranty information (workmanship – one year and structural integrity – five years when Archadeck exerts control as your remodeling contractor) are additional components of the contract documents which help make the process as smooth as possible.

Post construction landscaping (something we NEVER do) and yard repair are items which are not part of our contract and are usually handled by the homeowner after we complete the project. However, yard repair can be coordinated through Archadeck as an above contract item and incurs additional costs which must be negotiated in writing, separately.

hassle-free no textRegarding start and end dates, we schedule by the first in first out concept. Once a crew is assigned to your project they are yours (unless you are advised differently) until they are finished; this is to minimize the disruption in your life. Throughout your project, there will be segments of time during which the crew will not be on the jobsite and this in no way means they are not working on your job. A lot of coordination items such as debris hauls or material runs as well as employee doctor appointments or sick days and inclement weather days require time away from the site. Unfortunately, bad weather today affects everyone in the queue for future start dates.

During our follow-up consultation we take the time prior to signing the contract to talk at length with you regarding each of these aspects of the project, making sure all details are included in the contract and expectations are clearly understood by both parties. This along with consistent, open communication throughout the building process helps to eliminate misunderstandings and validates what you’re getting for your investment.

Ultimately, contracts are similar to building permits, as they are both legal requirements which track the project. They’re to protect everyone involved – the homeowner, the contractor, and the municipality. If differences of opinion occur, permits and contracts serve to guide the relationships to successful completion.

During these expos and trades shows, we encounter homeowners with a multitude of questions regarding what we do and how we do it. Some come with pictures of their existing outdoor living space or structure (or the lack there of), some pull out quick pencil sketches of what they think they want and some just stop by to dream a little, and we’re comfortable with that.

However, I must confess, after twenty-five  years servicing the Miami and Ohio Valley and surrounding areas, there are some questions we receive and things people say, which still surprise me. Please allow me to share some of our typical, and our not-so-typical questions and our answers:

Q: Your company name begins with Archadeck, so does that mean you only build decks?

We also design and build screen rooms, sunrooms, porches, spa/pool decks, gazebos, pergolas, outdoor rooms…any combination of two or more of the aforementioned,  and so much more!

Q: We love our seventies style split level home and our backyard has a few issues: we want to keep the very large oak tree which is close to the back door and the yard has a slope on the side. Would you still be able to give us a multifunction outdoor living space which includes a deck, but doesn’t look like it was just stuck onto the back of the house?

A: The new deck complements the Tudor architecture of this home in Cincinnati, OH.Absolutely! Each structure is customized according to the way you want to live outdoors and to work in the space you have. Our goal also includes creating a space that looks original to your home, no matter what the age or style of architecture your home happens to be.

Q: I know you manufacture the Archadeck low maintenance decking materials, but who does all of your building?

A: We do not manufacture anything. We do however utilize the newest and highest quality low maintenance decking materials on the market today. We also design and build wooden decks such as pressure-treated, Ipe and other hardwoods. if you prefer low maintenance decking material wood, we offer a wide selection of colors and textures by TimberTech, AZEK, Envisions and Fiberon.
